The Brexit Clock is Ticking : No Progress in Negotiations

Only 320 Days left before Brexit on 30 March 2019. Authorities and Businesses should prepare for a hard Brexit. Is your company ready? Time to act now !

Today, Michel Barnier informed the Council, in EU27 format, of the status of the ongoing Brexit negotiations.  No significant progress has been made since the end of March, in spite of two negotiation rounds in April and May.

Agreement only on a few withdrawal topics – Nothing is Agreed until Everything is Agreed – Only Transition period if all withdrawal topics are agreed upon.

  • Agreement on citizens’ rights, the financial settlement and the transition period up to 31 December 2020.
  • Key withdrawal topics requiring further negotiations and an agreement by the end of June 2018 (target date set by the EU) :
    • The border between Ireland and Northern Ireland :
      • political agreement, but issues related to the avoidance of a hard border still need to be addressed;
      • no agreement on the correct operational solution yet;
      • no legal text yet (except for the Draft Withdrawal Agreement as proposed by the EU).
    • Governance and dispute settlement of the Withdrawal Agreement :
      • no agreement yet;
      • no legal text yet (except for the Draft Withdrawal Agreement as proposed by the EU).
    • Issues related to intellectual property, data and information and Euratom :
      • No agreement yet;
      • No legal text yet (except for the Draft Withdrawal Agreement as proposed by the EU).

Next steps :

  • Next EU Council meeting on negotiating progress on 28-29 June 2018
  • Start of approval and ratification process ultimately by October 2018
    • EU : first approval by the European Parliament (simple majority) and then by the Council of the EU (enhanced qualified majority)
    • UK Parliament
